It depends on the state. According to Texas Penal Code 21.07 Public Lewdness – ” a person commits an offense if he knowingly engages in any of the following acts in a public place, and if not in public place, is reckless about whether another will be alarmed or offended by his act: of sexual intercourse, deviate sexual intercourse, sexual contact, or act involving contact between the person’s mouth or genitals and the anus or genitals of an animal or fowl.
But yes it is illegal, It’s called Public Indecency. Public indecency is a Class 1 Misdemeanor. If it’s been committed 3 times, on the third time it’s considered a Class 6 Felony. The First Offense would be a Minimum of probation to Maximum of 2 years. The Second Offense would be Minimum 0 days to Maximum 2.75 years. The Third Offense would be Minimum of probation to Maximum of 5.75 years. It also depends on the age of the accuser under 15 it’s a felony the first time, over than it’s just a misdemeanor.
